9. International data transfers

Some of our service providers or their subprocessors may be located outside Spain or the European Economic Area, or may process personal data from countries outside the European Economic Area. Where personal data are transferred internationally, we will take reasonable steps to ensure that a lawful transfer mechanism and appropriate safeguards are used. No international transfer method can eliminate every risk. However, we expect our service providers to use safeguards appropriate to the nature of the information and the applicable legal requirements. You may contact hello@aeroleadership.com for more information about the safeguards used for a relevant transfer.

10. Data retention

We retain personal data only for as long as reasonably necessary for the purposes described in this Privacy Policy, including legal, accounting, tax, security and dispute- resolution requirements. The following general periods apply.

10.1 Account information

Account and course information will generally be retained while the account remains active. An account may remain in place until the user requests deletion, subject to:

  • Legally required retention periods;
  • Payment and accounting records;
  • Fraud-prevention needs;
  • Unresolved disputes;
  • Legal claims; and
  • Information that must be retained to record an opt-out or prior transaction.

Course access may expire under the applicable purchase terms even when limited account records remain stored.

10.2 Purchase and billing records

Invoices, transaction records and other business documentation may be retained for at least six years, or longer where another legal obligation, audit, dispute or legal claim requires it. Payment providers may apply their own legally required retention periods.

10.3 Course-progress information

Course-progress information may be retained while the account exists and for a reasonable period afterwards where necessary to:

  • Confirm completion;
  • Restore an account;
  • Resolve an access dispute;
  • Maintain organizational training records; or
  • Establish, exercise or defend a legal claim.

Where an account is deleted and no lawful retention reason remains, course-progress information will be deleted or anonymized.

10.4 Analytics information

Analytics information will generally be retained for between 14 and 26 months, depending on the configuration of the analytics service. Aggregated or anonymized statistics that can no longer reasonably identify a person may be retained for longer.

10.5 Marketing information

Newsletter information will normally be retained until you unsubscribe or withdraw consent. After an unsubscribe request, we may retain limited information, such as the email address and opt-out date, on a suppression list to ensure that we respect the request.

10.6 Communications

Customer-support and ordinary business communications may be retained for as long as necessary to respond to the enquiry and for a reasonable period afterwards. Communications connected with a transaction, complaint or legal claim may be retained for the applicable legal limitation period.

10.7 Cookie-consent records

Records of cookie or marketing consent may be retained for as long as reasonably necessary to demonstrate compliance and manage your preferences.

11. Account deletion

You may request deletion of your Aero Leadership account by contacting hello@aeroleadership.com. Deleting an account may result in the permanent loss of:

  • Course access;
  • Course progress;
  • Completion records;
  • Saved preferences; and
  • Other account-related information.

Account deletion does not necessarily require the deletion of information that Aero Leadership must retain for legal, accounting, fraud-prevention, dispute-resolution or legal- claims purposes. Where information must be retained, it will be restricted to the relevant purpose and deleted or anonymized when that reason no longer applies.

12. Your data-protection rights

Subject to applicable conditions and exceptions, you may have the following rights.

You may ask whether we process your personal data and request a copy of that data.

12.2 Right to rectification

You may ask us to correct inaccurate personal data or complete incomplete information.

12.3 Right to erasure

You may ask us to delete personal data where there is no longer a lawful reason to retain it. This right is not absolute. We may retain information where necessary to comply with a legal obligation or establish, exercise or defend legal claims.

12.4 Right to restriction

You may ask us to restrict processing in certain circumstances, including while the accuracy or lawfulness of processing is being assessed.

12.5 Right to data portability

Where processing is based on consent or a contract and is performed by automated means, you may request relevant personal data in a structured, commonly used and machine-readable format. Where technically feasible, you may also request that it be transferred directly to another controller.

12.6 Right to object

You may object to processing based on legitimate interests. We will stop the relevant processing unless we demonstrate compelling legitimate grounds that override your interests, rights and freedoms or the processing is necessary for legal claims. You may object to direct marketing at any time. Where you object to direct marketing, we will stop using your personal data for that purpose.

12.7 Right to withdraw consent

Where processing is based on consent, you may withdraw your consent at any time. Withdrawal will not affect the lawfulness of processing carried out before the withdrawal.

12.8 Rights relating to automated decisions

You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal or similarly significant effects, except where permitted by applicable law and subject to appropriate safeguards. Aero Leadership does not currently use personal data to make solely automated decisions that produce legal or similarly significant effects concerning users. Analytics, advertising measurement and course-progress tracking do not themselves determine a person’s legal rights.

12.9 Right to lodge a complaint

You have the right to lodge a complaint with a competent data-protection supervisory authority. In Spain, the relevant authority is the Agencia Española de Protección de Datos, or AEPD. You may also be entitled to complain to the supervisory authority in the European Union or European Economic Area country where you live, work or believe an infringement occurred.

13. How to exercise your rights

To exercise a data-protection right, contact: Email: hello@aeroleadership.com Please clearly describe:

  • Which right you wish to exercise;
  • The account or email address involved;
  • The information or processing concerned; and
  • Any details that will help us identify the relevant records.

We may request reasonable information to verify your identity before responding. This protects personal data from unauthorized access or deletion. We will respond within the period required by applicable law. Under the GDPR, this will ordinarily be within one month, although the period may be extended where a request is complex or multiple requests have been made. Exercising your rights is normally free of charge. A reasonable fee may be charged, or a request may be refused, where a request is manifestly unfounded or excessive, as permitted by law.

14. Newsletter and marketing choices

  • A customer-support request.

15. Security

We use reasonable technical and organizational measures intended to protect personal data against:

  • Unauthorized access;
  • Unlawful processing;

  • Misuse.

These measures may include:

16. Personal-data breaches

Where a personal-data breach occurs, we will assess the incident and take appropriate steps to contain and investigate it. Where required by applicable law, we will notify the competent supervisory authority and affected individuals within the legally applicable period.

18. Third-party links and services

Our website or courses may contain links to third-party websites, services or resources. Selecting a third-party link may allow that third party to collect or process information. Aero Leadership does not control independent third-party websites and is not responsible for their privacy practices. You should review the privacy information provided by a third party before submitting personal data to it.

19. Organizational and multi-seat accounts

Where a company, non-profit organization or other entity purchases multiple course seats, the organization may provide limited information about authorized participants, such as:

  • Name;
  • Business email address;
  • Role;
  • Seat allocation; and
  • Licence status.

Depending on the arrangement, the organization and Aero Leadership may each have separate responsibilities for the personal data they process. We may update this Privacy Policy when:

  • Our services change;
  • We introduce or remove a provider;

  • We need to clarify how personal data are handled.

The latest version will be posted on the Aero Leadership website with an updated “Last updated” date. Where a change materially affects how we process personal data, we may provide additional notice by email, account notification, website notice or another appropriate method. Where required, we will request new consent before carrying out materially different consent-based processing.

23. Language

This Privacy Policy may be made available in more than one language. Where translations differ, the version identified as legally controlling in the Aero Leadership Terms of Service will apply, to the extent permitted by law.
